Ok I had a stroke off luck. My brothers GF has a lot of knowledge of architecture. So I asked her to have a look at it she told me the following:
the Statue we are looking at is St John. She believes this to be the Hofkirche in Dresden. I had a look at it using Streetview. I wasn't able to find the exact location of this photo. But judging at the combination of the collumns/pillars and cobble stones around it it must be right.
I had A quick look at wikipedia and it says this church was badly damaged during the allied bombardments. But I'm still wondering what the load of this picture/location is.

Hofkirche, in Schlossplatz. Dresde.
A paving stone with the letter "N" carved in the tradition marks the place from which the Emperor Napoleon and his troops went into battle of Dresden on August 26 of 1813.
In 1945 , during World War II , the church suffered from the bombing allies . The building burned to the ground, the dome collapsed and the exterior walls were badly damaged. The reconstruction lasted until 1965 . The result of the bombing is still significant comparing the various tones of stones.
